This form must be completed for each soccer player (participant) and must be agreed/signed by the player’s parent or legal guardian on GotSport electronically. No player will be allowed to participate in Monterey Condors Club’s practices or activities like league games or tournament games without this form, properly executed, and on file.

PROTOCOL ACKNOWLEDGEMENT AND RELEASE OF LIABILITY WAIVER.
Please read the document thoroughly and sign the waiver. NO PLAYER WILL BE ALLOWED TO ATTEND THE IN PERSON TRAINING UNTIL THEIR PARENT/GUARDIAN SIGNS THE WAIVER. On behalf of myself and my son, daughter, or person for whom I serve as legal guardian (the “Participant”), I understand soccer is a physical sport and the participation in Monterey Condor Club (hereinafter referred to as “MCC” the “Club”) or any soccer program has inherent risks that cannot be eliminated and that there is inherent risk of potential exposure to infectious diseases, including but not limited to COVID-19/Coronavirus that cannot be eliminated. On behalf of myself, the Participant, my family, personal representatives, assigns and insurers, I now and forever release, waive, discharge, and covenant not to sue Monterey Condors Club, each member of its Board of Directors, each manager and coach, each referee, the City or County (collectively the “Parties”) from and of any and all claims, damages, debts, liabilities, actions and causes of action whatsoever, of every nature, character and description, known, unknown, discovered, undiscovered, suspected or unsuspected (collectively “Claims”) including, but not limited to, all Claims arising out of or in any way related to Monterey Condors Club, any Party’s negligence, any emergency medical care administered, any concussion related injuries, any illness or infection or disease or injury or death, any pandemic or public health situation, any COVID-19 or Coronavirus related health issue or exposure, any change in these protocols or new protocols, Participant’s participation in Monterey Condors Club’s program, and the effectiveness of the electronic signature below. I expressly waive all rights under California Civil Code Section 1542 which provides: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” According to the guidelines issued by the California Department of Public Health on February 19, 2021 (“Guidelines”), youth may begin returning to team soccer competition provided the conditions set forth in the Guidelines are satisfied. One of the conditions required under the Guidelines is that each child’s parent or legal guardian sign an informed consent indicating the parent or legal guardian understands and acknowledges the risks of the youth returning to competition. Execution of this informed consent (“Consent”) satisfies that condition. As stated in the Guidelines, COVID-19 continues to pose a severe risk to communities and requires all people in California to follow recommended precautions. In addition, general information regarding COVID-19 and recommended precautions that everyone should take can be found on the CDC website www.cdc.gov. The Guidelines set forth the specific risks related to COVID-19 that youths face in returning to organizing sporting competition. In signing below, you are indicating you have been provided access to the Guidelines and understand the risks to your child, you and your family associated with your child’s return to competitive athletic competition as set forth in the Guidelines. Specifically, you understand that, with your child’s return to soccer practice and competition, there is a risk of contracting Covid-19 and this risk increases when face coverings are not worn and physical distancing is not maintained. Further, this risk increases with greater exertion levels and when mixing cohorts and groups, particularly when from different communities.
- I represent that I have authority to agree to all terms herein on behalf of the Participant. I certify that my child is in good health, and may participate in strenuous physical activities at the tryouts. I certify that there are no physical limitations to my child’s participation in the Monterey Condors Club’s open tryouts. Further, I agree to defend, hold harmless, and indemnify each of the Parties from and against any and all damages (including attorneys’ fees) arising out of, or in any way related to Participant’s participation in Monterey Condors Club activities, any negligence of myself or Participant, any illness or infection or disease or injury or death, any pandemic or public health situation, any COVID-19 or Coronavirus related health issue or exposure, or my right to agree to any terms herein on behalf of the Participant. In case of emergency, I authorize participant(s) to be treated by emergency personnel (e.g. EMT, First Responder, E.R. Physician).
- I hereby grant permission to the Monterey Condors Club and its legal representatives, assigns, and those acting on its behalf, to use any picture, video or audio recording of my child taken in connection with the tryouts for all manner of advertising, trade, promotion, exhibition, or any other lawful purpose related to youth soccer whatsoever and in any form or medium.
- I have read and understood the Guidelines and have had the opportunity to ask questions of my Club with respect to my child’s return to competition. I understand that my child’s participation is voluntary and that I am free to withdraw my child at any time.
- I also agree to comply with the Guidelines and such other applicable federal, state, local, Club and league soccer laws, regulations, policies, procedures and guidelines.
- I hereby agree to this waiver in order for my child to participate in the Club’s season.

I, the undersigned, in consideration for my voluntary participation in organized soccer, do hereby willfully acknowledge that my signature
below attests to my understanding and agreement that:
- My child and I have read and agree to abide by the rules/expectations of Monterey Condors Club as explained.
- I hereby acknowledge that I am familiar with the nature and risk of concussion and traumatic brain injury while participating in competitive soccer program (NorCal Premier, CalNorth) including the risks associated with continuing to compete after a concussion or traumatic brain injury. I have reviewed and understand the symptoms and warning signs of SCA (Involuntary eye movements, poor hand-eye coordination, problem with balance and coordination, slurred speech, trouble processing and remembering information (learning disabilities))
- -Soccer is a physical, contact, sport that involves the risk of injury. I assume all risks and hazards associated with my participation in the sport. I am in proper physical condition to participate in soccer practices and games and have no illness, disease or existing injury or physical defect that would be aggravated by my participation. I will inform my coach if this status changes. I further acknowledge that this risk may involve loss or damage to me or my property, or other unforeseen consequences, including those which may be due to the unavailability of immediate emergency medical care. I have a current medical consent form in force and on file with Monterey Condors Club. I will wear shin guards, properly-fitted and appropriate shoes, and other protective equipment that may be needed or required, as provided by US soccer rules, to all events.
- Permission to administer emergency medical care: I consent for an emergency medical care provider to administer any emergency medical care deemed advisable to the welfare of the herein named player while the player member is practicing for or participating in scrimmages, trainings and/or games and practices. Further, this authorization permits, if reasonable efforts to contact me have been
unsuccessful, physicians to hospitalize, secure appropriate consultation, to order injections, anesthesia (local, general, or both) or surgery for the herein named player member. I hereby agree to pay for physicians’ and/or surgeons’ fees, hospital charges, and related expenses for such emergency medical care. I further give permission to Monterey Condors Club’s administration, coaches and/or team trainer to consult with the Authorized Medical Professional who executes care regarding a medical condition or injury to the herein named player member. - The information on this form shall be treated as confidential by Monterey Condors Club’s personnel. It may be used by the Monterey Condors Club’s administration, coaches and team trainer to determine athletic eligibility to play or practice, to identify to the best of their ability in that moment possible medical conditions and injuries during play to discuss with you if available and determine if player should sit out, and to promote safety and injury prevention. In the event of an emergency, the information contained from medical release form may be shared with emergency medical personnel. Information about an injury or medical condition will not be shared with the public or media without written consent of the parent(s) or guardian(s).
- I hereby acknowledge that I am familiar with the requirements of Monterey Condors Club and US Youth Soccer concerning the eligibility of players to participate in Practices, Scrimmages, and/or Games.
- My player status will be kept in good standing. I will not compromise myself in such a way as to do harm to Monterey Condors Club, knowing that players may be dismissed from participation, with possible loss of payment or dues, for violent conduct or unsportsmanlike behavior on or off the field of play.
- I authorize my photograph, picture or likeness, and voice to appear in any documentary, promotion (including advertising and with sponsors), television, print, video, social media accounts or radio coverage of the club, league or tournament, without compensation.
- I understand that I am a primary player for Monterey Condors Club and as such, the club holds all player passes. If I am asked to guest play or participate in any soccer games/tournaments including 3v3, 7v7 and the like outside of Monterey Condors Club program(s) I will need to get permission from the DOC.
- I have completely read this document and fully understand its contents. I acknowledge that I have signed this document voluntarily. My signature attests to this on behalf of myself and my executors, personal representatives, administrators, heirs, next-of-kin, successors, and assigns.

As the parent and natural guardian or legal guardian of the participant, I hereby agree to the foregoing Waiver of Liability and Release for, and on behalf of, the participant (player/minor) named above. I hereby bind myself, the minor, and all other assigns to the terms of the Waiver of Liability and Release. I represent and certify that I have the legal capacity and the authority to act for, and on behalf of, the minor in the execution of this Waiver of Liability and Release Form.
